I. Eligibility: The Applebee's Services Inc. Video Submission Promotion is open to legal residents of The United States who are 13 years of age or older at time of entry. VOID WHEREVER PROHIBITED OR RESTRICTED BY LAW. You (a) agree to be bound by this Submission Agreement and by the decisions of Applebee's, which are final in all matters relating to this Promotion, and (b) acknowledge compliance with the terms and conditions of this Submission Agreement.

II. To Enter: There is no cost to submit your Video Submission on the Website. You may enter by submitting a short video clip to the Applebee's website at www.applebees.com and following the instructions for submission on the Website. You may enter it many times as you wish, so long as you use a different Video Submission. All Video Submissions become the property of Applebee's and will not be returned. You agree that Applebee's has the right to use or feature, or not use or feature, any part or all of your Video Submission and entry information on www.applebees.com, without restrictions on territory, time or any other use restrictions.

III. Submission Requirements: Your Video Submission should depict, in a truthful, non-disparaging and non-misleading manner, "Your own personal experience and your friend's personal experience at Applebee's restaurant." By submitting the Video Submission, you warrant that (i) the statements made in the Video Submission are accurate and reflect you and your friend's true experience at Applebee's, (ii) any statements made in the Video Submission are made on a voluntary basis, (iii) you and your friends are actual Applebee's customers, (iv) you and your friends are not being compensated for any statements or endorsement, (v) you will secure all releases for anyone appearing in your Video Submission, (v) the Video Submission is your original work and your sole and exclusive property, (vi) you have all exclusive rights, and (vii) you have attained written permission from your friends to appear in the Video Submission.

If you are a minor, you warrant that you have your parent or legal guardian's permission to submit a Video Submission for the purpose of this promotion. You also warrant that (i) it is your responsibility to secure Image Consent Release Forms for all individuals appearing in your Video Submission, (ii) you have the authority to use the name and likeness of all individuals appearing in your Video Submission, (iii) you will provide any documentation and releases necessary to prove your unrestricted ownership in your Video Submissions, (v) you grant Applebee's the right to use such materials without limitation for any purpose, without any compensation. Any Video submission Applebee's deems offensive, inappropriate or in potential violation of any third party rights, may be deleted and not displayed on the Website. Applebee's may modify the Video Submission as it deems necessary, in its sole discretion. Applebee's does not assume responsibility for, and will not resolve any disputes that may arise among you and any individual who may have a collective or creative interest in any Video Submission in connection with this Promotion. Applebee's can delete Video Submissions at any time and for any reason, without notice.

IV. Certain Rights: You agree that (i) Applebee's may use any ideas, concepts, material, or expression in whole or in part, contained in your Video Submission; (ii) that you have obtained all rights, permissions releases and licenses necessary to use the Video Submissions for any purpose, (iii) no Video Submission, or any part, infringes any trademark or copyright or otherwise violates anyone's proprietary rights or right of privacy or publicity, (iv) by submitting a video, you consent to Applebee's exhibiting such Video Submission, or any portion or derivative of it, in all media with no territory or time restrictions, (v) you indemnify and hold harmless Applebee's and any other promotion entities from any claims, suits, losses damages and expenses (including, without limitation, reasonable attorney's fees) that arise from any breach of the Submission Agreement.

V. General Terms: The Applebee's assumes no responsibility for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in this Promotion or by any human error. Applebee's is not responsible for any problems or technical malfunction of any kind or at any web site, including, any injury or damage to your or any other person's computer related to or resulting from participation or downloading any materials in this Promotion. Applebee's reserves the right in its sole discretion to terminate or modify the Applebee's Video Submission Promotion, and any Video Submission submitted for this promotion. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, APPLEBEE'S RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE KANSAS COURTS (STATE AND FEDERAL), LOCATED IN JOHNSON COUNTY, HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE PROMOTION AND THE LAWS OF THE STATE OF KANSAS WILL GOVERN THE PROMOTION. YOU WAIVE ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND AGREE TO SUBMIT TO THE JURISDICTION OF THOSE COURTS.
